What types of legal matters does The Rothman Law Offices handle?
Estate Planning and Asset Protection involves the careful use of Wills, Trusts, Durable Powers of Attorney, Health Care Surrogate Designations, and Living Wills. Certain aspects of Estate Planning protect you while living, while other aspects protect you, as well as your family members, upon dying. Proper Estate Planning can accomplish a number of things, such as providing for the care of minor children in the event of an unforeseen disability or death, protect and transfer assets and valuables to loved ones upon dying, and avoid or mitigate estate taxes. Additionally, if the client is a business owner, Estate Planning can protect the sanctity of the family business through prudent Business Succession Planning.
Having a will, along with other essential documents, can lend a great deal of peace of mind to individuals. Everyone's situation is different, which is something we understand at The Rothman Law Offices. Therefore, we will tailor an Estate Plan that's just right for you.
Probate Law is the legal process in which the assets of a deceased person are passed to his or her heirs. Sometimes, probate is necessary even if there is a will. Often, assets needing probate may include bank accounts, real estate, IRAs, as well as other retirement plans and life insurance policies. Some types of Estate Planning may avoid probate.
Small Business/Transactional Law
We can assist you with your small business needs, such as business formation and planning, setting up corporations/LLCs, preparing agreements, reviewing documents and agreements, and Business Succession Planning/Business Exit Strategies. In addition, we represent, assist, and negotiate on behalf of our clients in the sale and purchase of their businesses and franchises.
Real Estate Law is multi-faceted. The Rothman Law Offices represents clients with residential or commercial legal needs. We deal with matters such as zoning, planning and land use, as well as title disputes and quiet title actions. In addition, we represent a number of Homeowner’s Associations. We also handle real estate contract disputes, such as breach of a land purchase contract or a lease agreement. Whether you are a buyer, seller, landlord, tenant, or title company, we are equipped to negotiate a resolution and, if necessary, pursue protection of our client’s rights in court.
Family Law may include divorce, child custody or visitation disputes, spousal and/or child support issues, paternity disputes, division of property, parental relocation, issues with out-of-state parents, and domestic violence injunctions, just to name a few. Realizing that these types of situations can be emotionally and financially difficult for individuals and families, The Rothman Law Offices will use various tools, such as negotiations, settlement conferences, mediation, and aggressive representation in court, to seek a practical and desirable outcome.
Adoption can be an overwhelming process for a family, but also very rewarding. We welcome the opportunity to help you and your family with this endeavor. We can assist you with adoptions through agencies, situations in which a parent is giving up parental rights, in cases of unfit parenting, as well as other scenarios. The goal of The Rothman Law Offices is to facilitate this process for you so you can focus on what is important – your family.
The Fair Debt Collection Practices Act mandates specific guidelines that debt collectors must follow. If a debt collector fails to comply with this, and is using unfair practices with you in their attempts to collect, you can pursue legal action against them. Often times, if they have violated this law, you are entitled to not only monetary damages, but attorney’s fees. Even if you owe the money, debt collectors must abide by this law while attempting to collect the debt. If you are being harassed by a debt collector, or are dealing with a debt collector that you feel is using unfair trade practices, call The Rothman Law Offices to help you. If you choose to hire our firm on your behalf to handle this matter, the debt collector can no longer call or contact you – they must deal with us directly.
The Lemon Law has been designed to protect consumers who have purchased automobiles, other types of motor vehicles - such as RV’s, boats, or other watercrafts, equipment – such as computers, and other products that fail to perform in terms of acceptable quality and performance. Obviously, a situation such as this creates a hardship for the owner, and often times the owner has options they are unaware of to remedy this problem. If your purchase is indeed a Lemon, you may be entitled to a cash settlement, a replacement, or your money back. If you are dissatisfied with the answers you have gotten from the dealer from which you purchased your automobile, motor vehicle, equipment or product, call The Rothman Law Offices and we will attempt to resolve your issue with either the dealer or the manufacturer. Sometimes, these situations are considered Breach of Warranty. A Breach of Warranty is a violation of a contract or agreement between a buyer and a seller. A warranty constitutes a guarantee or an obligation on behalf of the seller that the product sold will perform as factually stated. If you have made a purchase, the purchased product is not performing up to an acceptable standard, and the manufacturer, dealer or seller is not upholding the warranty, call The Rothman Law Offices.

The problem may revolve around a failed business venture, unpaid accounts, commercial disputes, insurance disputes, neighborhood disputes, or various other disagreements. The Rothman Law Offices provides the sound guidance and representation needed to help our clients navigate toward a satisfactory resolution of the dispute.
Criminal Law encompasses the representation of an individual who has been charged with, or may be charged with, a crime. The crime for which an individual may be accused could be a white-collar crime, DUI, robbery, fraud, drug possession, criminal assault, traffic violation, and many others. The Rothman Law Offices is equipped to handle all types of criminal matters, whether it is a misdemeanor, felony, state, or federal case.
